It is hereby specified that the present conditions govern the sale of its products by AFTER BEACH to any individual or legal entity making a purchase via the webwebsite www.after-beach-en.com referred to as "the CLIENT" hereinafter.

Any order placed on the webwebsite www.after-beach.com requires the CLIENT to accept the General Terms and Conditions of Sale in their entirety beforehand and without reservation. In the event of disagreement with the terms and conditions of the General Terms and Conditions of Sale, the CLIENT must not use the Website.

AFTER BEACH has the right to adapt or modify its General Terms and Conditions of Sale at any time and without prior notice, the adaptations or modifications being applicable to all orders placed after the adaptations or modifications.

In case of modification, the General Terms and Conditions of Sale applicable to the CLIENT's order are those that were online and that the CLIENT accepted on the day of placing the order.

Article 1 - Definitions

The terms and expressions identified by a capital letter in the General Terms and Conditions of Sale have the meaning indicated below (whether they are used in the singular or plural).

General Terms and Conditions of Sale: refers to the present document, i.e. the terms and conditions that apply in the relationship between AFTER BEACH and the CLIENT.

Order: refers to the CLIENT's purchase order for one or more Products or Services placed via the Internet website www.after-beach.com or via the Customer Service Department

Website: refers to the Internet website accessible at www.after-beach.com

Product: refers to a product or service offered for sale on the Internet website www.after-beach.com

CUSTOMER: refers to a Natural or Legal Person, consumer, who uses the Internet website www.after-beach.com and acquires one or more Products, for his/her personal needs, having previously agreed to the General Terms and Conditions of Sale.

Article 2. Purpose

The present General Terms and Conditions of Sale aim to define the contractual relationship between AFTER BEACH and the CLIENT and the conditions applicable to any purchase made through the website www.after-beach.com.

By accepting these Terms and Conditions, you declare that you have reached the age of majority in your country, state or province of residence, and that you have given us your consent to allow any minor dependent on you to purchase from this online sales website.

The use of our products for any illegal or unauthorized purpose is prohibited.

AFTER BEACH reserves the right to modify these Terms and Conditions at any time, in order to comply with any new regulations or in order to improve the use of its website. Therefore, the applicable conditions will be those enforced at the date of the order by the CLIENT.

Article 3. Prices

The prices appearing on the product sheets of the internet catalog are prices in Euros (€) including all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products.

AFTER BEACH has the right to modify its prices at any time, meaning that the price appearing in the catalog on the day of the order will be the only one applicable to the CLIENT.

The products remain the property of www.after-beach.com until full payment has been received by www.after-beach.com.

Products on sale will be indicated by a "PROMOTION" sticker or by a crossed-out price. Our promotions are valid within the limits of available stocks at the time of the order and during the display period.

For CUSTOMERS outside mainland France, www.after-beach.com legally has to charge VAT on orders sent to most countries in the European Union.

For CUSTOMERS outside the European Union and French overseas departments and territories, orders are not subject to VAT, but may be subject to local taxes and customs duties in force in the country of receipt. These duties and sums are not the responsibility of www.after-beach.com. They are the responsibility of the CUSTOMER.

Warning: Any inaccurate information provided by the CUSTOMER in order to evade VAT may result in civil fines and criminal prosecution.

The prices of the Products indicated on the www.after-beach.com website do not include the processing and shipping costs which are invoiced in addition to the price of the Products purchased and according to the total amount of the order.

Article 4. Order

The contractual information is written in French and will be the subject of a confirmation containing this contractual information at the latest at the time of delivery. AFTER BEACH has the right to cancel or refuse any order from a customer with whom there is a dispute over the payment of a previous order.

To order Products on the Website www.after-beach.com, the CLIENT must create an account by providing the information required in the registration form.

To this end, the CUSTOMER declares that he/she will provide complete personal information that is correct and that will enable him/her to be accurately identified in any situation. Any false or slanderous personal information may lead to the closure of the CUSTOMER's account and the cancellation of their Order.

The account creation section is accessible directly from the main menu bar. Each time the CUSTOMER visits the website, if he/she wishes to order or consult his/her account (status of orders, personal information, etc.), he/she must identify him/herself using this information.

Article 5. Payment

The price of the Products and the costs of logistical preparation and delivery are to be paid in full by the CUSTOMER at the time the Order is placed.

The website www.after-beach.com offers the Customer the possibility to pay for the order by :

After choosing the credit card payment method, the Customer is redirected to the secure interface of the payment system in order to enter his/her personal credit card details in complete safety. If the payment is accepted, the order is submitted and the contract is definitively formed. Payment by bank card is irrevocable.

Article 6. Right of Withdrawal

According to Article L121-21 of the French Consumer Code, the Customer has a period of fourteen working days upon receipt of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty.

The products must be returned in their original packaging, unused, accompanied by the initial signed delivery note. The return costs are at the Customer's expense.

Article 7. Delivery

Once the Order has been paid for, the Products will be delivered to the delivery address indicated by the CUSTOMER when the Order was placed. An email will be sent to the CUSTOMER to inform them of the shipment of the Products. The CUSTOMER may choose between different delivery methods.

Shipping costs are calculated according to the delivery method chosen (at home, relay point, post office...), the weight of the package and the destination.

Delivery times are only given as an indication, if they exceed thirty days from the order, the sales contract may be terminated and the Customer reimbursed.

Article 8. Guarantee

All products offered by AFTER BEACH on the webwebsite www.after-beach.com benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it can be returned to the company AFTER BEACH, which will take it back, exchange it or reimburse it. All claims, requests for exchange or reimbursement must be made by post to the following address: AFTER BEACH - 11 Impasse Aragon - 31130 Balma - France, within thirty days of delivery.

Article 9. Responsibility

The company AFTER BEACH has, for all stages of access to the website, the ordering process, the delivery, the customer service or any subsequent services, only an obligation of means. AFTER BEACH cannot be held responsible for any inconvenience or damage inherent in the use of the internet, in particular loss of data, intrusion, viruses, breakdown of service, and other involuntary problems, or for any event qualified as force majeure, according to case law.

The computerized registers kept in AFTER BEACH's information systems under reasonable security conditions will be considered as proof of communication, orders and payments between AFTER BEACH and the Client.

Article 10 - Security

The website www.after-beach.com is subject to a security system: the SSL encryption process has been adopted but all the scrambling and encryption processes have also been reinforced to protect all sensitive data linked to the means of payment as effectively as possible.

Article 11 - Intellectual property

Article 13. Force majeure

The execution by AFTER BEACH of all or part of its obligations, in particular delivery obligations, will be suspended in the event of a fortuitous event or force majeure that would hinder or delay the execution of the obligations. This includes, but is not limited to, war, riots, insurrection, social unrest and strikes of any kind. AFTER BEACH will inform the CLIENTS of the occurrence of a fortuitous event or force majeure within seven days of its occurrence. In the event that this suspension continues beyond a period of fifteen days, the CLIENT will have the option of canceling the order in progress, and the price of the Products ordered and the delivery costs paid will then be reimbursed.

Article 14. Applicable laws and competent jurisdictions

The General Terms of Sale are subject to French law. Only the French version of these General Terms and Conditions of Sale is authentic. In the event of any difficulty arising in connection with the Order, the delivery of the Products and, more generally, the execution of the sale, the CUSTOMER shall have the possibility, before taking any legal action, of seeking an amicable solution, in particular with the help of a consumer association or any other advisor of his choice.
